1. Agreement
These Terms of Use ("Terms") are a legally binding agreement between you and Altercorn Group s.r.o. ("mspy.live", "we", "us"), the operator of mspy.live. They apply to our website, the mspy.live Parent App, the mspy.live Family Member App and all related services (together, the "Service"). By creating an account, installing an app, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our End User License Agreement, our Refund Policy and our Compatibility Policy. If you do not agree, please do not use the Service.
2. Definitions
- Parent App — the app used by adults in a Family Circle to view the family map, status, alerts and timeline.
- Family Member App — the app installed on the phone of a person who shares their location and safety status with their circle.
- Family Circle — a private group of people who have agreed to share safety information with one another through mspy.live.
- Circle Admin — the adult account holder who creates and manages a Family Circle and its subscription.
- Member — any person who has joined a Family Circle through the Family Member App.
- Subscription — a paid plan giving access to Premium features for a recurring billing period.
- Free Trial — the 2-day period during which a new Family Circle can use the Service without payment.
3. Who may use mspy.live
- You must be at least 18 years old and able to enter into a binding contract to create an account or become a Circle Admin.
- A person under 18 may use the Family Member App only as a member of a circle set up by their parent or lawful guardian, who accepts these Terms on the child's behalf.
- You must provide accurate information when you register and keep it up to date.
- You may not use the Service if you have previously been suspended or removed from it for misuse.
4. Lawful, consent-based use
You agree that you will pair a phone with your Family Circle only if it belongs to:
- your own child under 18, for whom you are the parent or lawful guardian; or
- an adult who has personally accepted the invitation on their own phone after seeing what will be shared and with whom.
You must not install the Family Member App on another person's phone without their knowledge, pressure anyone into sharing, or try to hide, disguise or disable the sharing indicator and privacy controls. Doing so breaches these Terms and may be a criminal offence under the Information Technology Act, 2000 and other laws. We may suspend or terminate any account used in that way and may cooperate with law-enforcement requests.
You are responsible for making sure your use of the Service complies with the laws that apply to you. We do not provide legal advice; if you are unsure whether a particular use is lawful, consult a lawyer before proceeding.
5. Accounts and security
- Keep your password confidential and do not share your account with people outside your Family Circle.
- You are responsible for everything done through your account. Tell us immediately at [SUPPORT EMAIL] if you believe your account has been accessed without permission.
- One Circle Admin account may manage one Family Circle, with the number of members allowed by your plan.
- We may require you to verify your email address or mobile number before certain features are available.
6. What the Service does and does not do
mspy.live shows the location, safety status, battery level and recent activity of consenting members, sends safe-zone, battery, check-in and SOS notifications, and provides privacy controls to every member.
- Location accuracy depends on the phone's GPS, Wi-Fi and mobile network, its settings and its battery. Positions may be delayed, approximate or unavailable, especially indoors, underground or in areas with poor coverage.
- Notifications depend on the phone having an internet connection and on permissions and battery settings allowing the app to run in the background.
- The Service is a convenience that supports, and does not replace, a family's own judgement and care.
7. Free trial, subscriptions and renewal
- Free Trial. New Family Circles receive a 2-day Free Trial. If you add a payment method during the trial, your Premium Family Plan subscription begins automatically when the trial ends unless you cancel before then. If you do not add a payment method, access to Premium features ends when the trial expires.
- Premium Family Plan. The Premium Family Plan is currently priced at ₹999 per month, inclusive of applicable GST, and is billed in advance each month.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. We will tell you at least 7 days in advance of any price change that affects your next renewal.
- Cancellation. You can cancel at any time from Account → Subscription. Cancellation takes effect at the end of the current billing period, and you keep Premium access until then.
- Plan changes. If you change plans, the new plan starts at your next renewal unless we say otherwise at the time.
8. Payments and billing
- Payments are processed by our payment partner. By subscribing you authorise us and our partner to charge your chosen payment method for each billing period.
- If a payment fails, we may retry it over the following 7 days and may suspend Premium features until payment succeeds. If payment cannot be collected, the subscription is cancelled.
- Prices are shown in Indian Rupees. Your bank or card issuer may apply its own fees or currency conversion.
- Receipts are sent to your registered email address and are available in the app.
9. Refunds
Refunds are governed by our Refund Policy, which explains when a refund is available, what is excluded and how to request one.
10. Device compatibility
The Service works only on supported devices and operating-system versions with the required permissions enabled, as described in our Compatibility Policy. Please check compatibility, and use the Free Trial to confirm the Service works for your family, before paying for a subscription.
11. Acceptable use
You must not:
- use the Service to monitor, stalk, harass, intimidate or control any person, or in any way that violates their rights;
- pair a phone you are not entitled to pair under section 4;
- tamper with, hide or disable the Family Member App's sharing indicator or privacy controls;
- attempt to access another user's account or data, or interfere with the security or operation of the Service;
- copy, modify, reverse engineer, resell or create derivative works of the Service except as the law expressly allows;
- use automated tools to access the Service, or use it to build a competing product;
- upload malicious code or content that is unlawful, abusive or infringes anyone's rights.
12. Intellectual property
The Service, including the apps, website, designs, logos, text and illustrations, is owned by mspy.live or its licensors and is protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for your family's own safety in accordance with these Terms and the EULA. All other rights are reserved. Any feedback you give us may be used to improve the Service without obligation to you.
13. Third-party services
The Service relies on third-party services such as map providers, app stores, push-notification services and payment processors, and may link to third-party websites. Those services have their own terms and privacy policies, and we are not responsible for their content, availability or practices.
14. Updates and changes to the Service
We regularly improve the Service and may add, change or remove features, release updates, or change supported devices. We will give reasonable notice of changes that materially reduce the features included in a paid plan, and you may cancel if you do not want to continue. We may also update these Terms; the updated version will be posted here with a new effective date, and for material changes we will notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
15. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free or secure, that location data will always be accurate or timely, or that any notification will be delivered at a particular time. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019 that cannot be excluded.
16. Limitation of liability
To the fullest extent permitted by law, mspy.live and its directors, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Service, including reliance on location data or notifications. Our total liability for all claims relating to the Service in any 12-month period is limited to the amount you paid us for the Service in that period. These limits do not apply to liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by our negligence.
17. Indemnity
You agree to indemnify and hold harmless mspy.live and its directors, employees and partners from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service, or your pairing of a phone without the consent required by section 4.
18. Termination
- You may delete your account at any time from Account → Delete account, or by writing to [SUPPORT EMAIL]. Deleting an account ends your subscription and removes your Family Circle.
- We may suspend or terminate your access immediately if you breach these Terms, in particular section 4 or section 11, if required by law, or if we discontinue the Service (in which case we will give at least 30 days' notice and refund any unused part of a prepaid subscription).
- Sections 12 and 15 to 20 survive termination.
19. Governing law and disputes
These Terms are governed by the laws of India. If you have a dispute with us, please contact us first at [SUPPORT EMAIL] so we can try to resolve it. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts at [CITY], India. Nothing in this section prevents you from using the consumer-dispute forums available under the Consumer Protection Act, 2019.
20. General terms
- These Terms, together with the policies they refer to, are the entire agreement between you and mspy.live about the Service.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- Our failure to enforce any provision is not a waiver of our right to do so later.
- You may not assign or transfer these Terms. We may assign them to a successor that takes over the Service and agrees to be bound by them.
- Notices to you will be sent to the email address on your account; notices to us should be sent to the address in section 21.
- These Terms are written in English. If a translation is provided, the English version prevails.
