1. Acceptance
This End User License Agreement ("EULA") is between you and Altercorn Group s.r.o. ("mspy.live", "we", "us") and covers the mspy.live Parent App and the mspy.live Family Member App (together, the "Apps"). By downloading, installing or using either App you accept this EULA together with our Terms of Use and Privacy Policy. If you do not accept, do not install or use the Apps. If you install the Family Member App on the phone of your child under 18, you accept this EULA on the child's behalf.
2. Licence grant
Subject to this EULA, mspy.live grants you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the Apps, in object-code form only, on devices that you are entitled to use under section 3, solely for your family's own safety and connection and not for any commercial purpose.
3. Devices you may use the apps on
- You may install the Parent App on your own devices.
- You may install the Family Member App on the phone of your child under 18 for whom you are the parent or lawful guardian, or on the phone of an adult who personally accepts the Family Circle invitation on that phone.
- You must not install the Family Member App on any other person's phone, and you must not use any method to make the App invisible, silence its sharing indicator, or prevent the member from using its privacy controls.
- You are responsible for making sure that your use of the Apps is lawful where you live. Installing monitoring software on a device without the user's knowledge may be a criminal offence. We do not give legal advice.
4. Restrictions
Except where the law expressly permits, you must not:
- copy, modify, translate, adapt or create derivative works of the Apps;
- reverse engineer, decompile, disassemble or otherwise try to obtain the source code of the Apps;
- rent, lease, lend, sell, sublicense, distribute or otherwise transfer the Apps or your licence to anyone else;
- remove or alter any copyright, trademark or other proprietary notice;
- interfere with the security features of the Apps, including the sharing indicator, consent screens and privacy controls;
- use the Apps on a device that has been rooted or jailbroken in a way that defeats their security features;
- use the Apps to monitor, harass, stalk or control any person, or in any way that violates another person's rights.
5. Ownership
The Apps are licensed, not sold. mspy.live and its licensors own all rights, title and interest in the Apps, including all intellectual-property rights. This EULA does not give you any ownership of the Apps or any right to use mspy.live's names, logos or trademarks.
6. Updates
We may release updates, upgrades and patches to the Apps from time to time, which may be installed automatically depending on your device settings. Updates are covered by this EULA unless they come with separate terms. Some updates may change or remove features, and older versions of the Apps may stop working with our servers; we will give reasonable notice where an update materially reduces the features of a paid plan.
7. Permissions and device data
To work, the Apps request certain permissions from the device's operating system. The Family Member App needs background location access ("Always" or equivalent) to share location, notification permission to deliver alerts, and may ask to be excluded from battery optimisation so it is not stopped in the background. The Apps collect the technical and location data described in our Privacy Policy and nothing more. You can review and change permissions in your device settings at any time; denying a permission may stop a feature from working.
8. Third-party and open-source components
The Apps include software components licensed from third parties, including open-source components. Those components are governed by their own licence terms, which are available in the Apps under Account → About → Licences, and nothing in this EULA restricts the rights you have under those licences.
9. Term and termination
- This EULA lasts for as long as you use the Apps.
- Your licence ends automatically if you breach this EULA or the Terms of Use, if your account is deleted, or if we withdraw the Apps from service.
- You may end this EULA at any time by deleting your account and uninstalling the Apps.
- When this EULA ends you must stop using the Apps and uninstall them. Sections 4, 5, 10, 11 and 13 survive termination.
10. Warranty disclaimer
To the fullest extent permitted by law, the Apps are provided "as is" and "as available", without warranties of any kind. We do not warrant that the Apps will be free of errors, that they will work on every device, or that location data and notifications will always be accurate, complete or timely. You are responsible for backing up the data on your device. Nothing in this EULA limits rights that cannot be excluded under Indian consumer-protection law.
11. Limitation of liability
To the fullest extent permitted by law, mspy.live will not be liable for any indirect, incidental, special, consequential or punitive loss arising out of or relating to the Apps, including any loss caused by reliance on location data or by a notification that was delayed or not delivered. Our total liability under this EULA is limited to the amount you paid for the Service in the 12 months before the claim arose. These limits do not apply to liability that cannot be limited by law.
12. International use
The Apps are designed for use in India. We do not promise that the Apps are appropriate or lawful to use in any other country. If you use the Apps outside India you do so on your own initiative and are responsible for complying with local law, including laws on location sharing, data protection and consent.
13. Governing law
This EULA is governed by the laws of India, and any dispute relating to it is subject to the exclusive jurisdiction of the courts at [CITY], India, without prejudice to any rights you have under the Consumer Protection Act, 2019.
